Statutory notice periods apply to all staff

Staff who are made redundant must be given a notice period before the end of their employment. The amount of notice depends on how long they’ve been employed.

The statutory redundancy notice periods are:

  • At least 1 week’s notice if employed between 1 month and 2 years
  • 1 week’s notice for each year if employed between 2 and 12 years
  • 12 weeks’ notice if employed for 12 years or more

The statutory rights of employees to minimum notice periods are set out in part 9, paragraph 86(1) of the Employment Rights Act 1996. Because this is statutory, these minimum entitlements apply to all staff, no matter the terms they're employed under.

The contractual notice period is the notice period in the employee’s contract. This may be longer than the statutory minimum
